Copyright as a Waqf Object in the Context of Fiqh and Positive Law

This research aimed to analyze the position of copyright as a waqf object from perspective fiqh and positive law. study was literature with normative approach. The data collection technique used in this is documentation technique. At same time, analysis descriptive inductive techniques. results indicated that protected by Sharia owner has right authority over his or her rules laws. Copyright permitted Islamic law long requirements for are met. reinforced decision Indonesian Ulema Council (MUI) number 1 MUNAS/VII/5/2005, which allows Intellectual Property Rights (IPR) object. permissibility also supported law, i.e. Law No. 41 2004 concerning Waqf Government Regulation 42 2006. In addition, part IPRs fulfils criteria object, valuable asset permissible whose ownership rights transferrable. Accordingly, legally such should not be violated.
